Terms of Service

These Terms of Service govern use of the sparkbeat website and mobile application. They are written to match the app’s current solo-supervisor retail workflow and should be reviewed by your attorney before release.

These Terms of Service ("Terms") are an agreement between you and Infinatec ("sparkbeat," "we," "our," or "us") regarding your access to and use of the sparkbeat mobile application, website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Eligibility and account access

You must be legally permitted to use the Service in your jurisdiction. If you create or use an account on behalf of a business, you represent that you have authority to bind that business to these Terms.

sparkbeat currently supports Sign in with Apple for authenticated access and may also offer a local Demo Mode for previewing the app experience.

2. The Service

sparkbeat is a retail management app intended to help supervisors organize store operations, including employee records, daily roster planning, event reminders, and performance reporting. Features may change over time, and some planned features described in marketing materials may not yet be available in the current app version.

3. Your responsibilities

You are responsible for the accuracy, legality, and permissions associated with the data you enter into the Service, including employee information, schedules, comments, events, workspace settings, and performance information.

  • You must only upload or store data you are authorized to use.
  • You must comply with applicable employment, privacy, labor, recordkeeping, and workplace laws.
  • You must maintain the confidentiality of your device and account access.

4. Acceptable use

You may not use the Service to violate any law, infringe another party’s rights, interfere with Service operation, attempt unauthorized access, reverse engineer restricted portions of the Service except where prohibited by law, or upload malicious code or harmful content.

5. Data, backups, and operational decisions

The Service is intended to support retail operations, not to replace your independent judgment. You remain solely responsible for staffing, scheduling, compliance, payroll, communications, and employment decisions.

Although sparkbeat may store data locally, cache data for offline continuity, or synchronize data with a backend service, you are responsible for reviewing information before relying on it for business decisions.

6. Notifications and device behavior

If you enable notifications, sparkbeat may schedule local reminders on your device for timed events and related operational alerts. Delivery depends on your device settings, permissions, network conditions where applicable, and platform behavior outside our control.

7. Intellectual property

The Service, including its software, design, branding, text, graphics, and related materials, is owned by or licensed to Infinatec and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended business purpose.

8. App Store terms

If you download the app through Apple’s App Store, you agree that these Terms are between you and Infinatec, not Apple. Apple has no obligation to furnish maintenance or support services for the app except as required by law. You also agree to comply with any applicable App Store usage rules.

9. Termination and account deletion

You may stop using the Service at any time. If you have an authenticated account, you may request deletion or use the in-app account deletion controls if available in your version of the app. We may suspend or terminate access if you violate these Terms, create risk for other users, or use the Service in an unlawful or abusive way.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or uninterrupted operation.

11. Limitation of liability

To the fullest extent permitted by law, Infinatec will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill arising from or relating to the Service.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of: (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Infinatec from claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your data, or your violation of these Terms or applicable law.

13. Changes to the Service or Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may also update these Terms. If we make material changes, we will update the effective date above and may provide additional notice where required by law.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where local law requires otherwise. Any dispute not subject to arbitration or small claims procedures will be brought in the courts located in California, unless applicable law requires otherwise.
